Understanding Alimony Eligibility in New Mexico

Under the family laws of New Mexico, Alimony or spousal support may be temporary, permanent, or transitional. The longer your marriage, the more most likely it will be that alimony is granted in your case. Even if you have a long marital relationship, the partner being asked to pay support needs to have the actual means to do so.

In Albuquerque, the family courts provide proposed spousal support guidelines. These guidelines are not binding in any court, however, it may work throughout negotiations to take a look at these standards.

How Is Alimony Determined in New Mexico?

There is no crystal clear method for alimony determined in New Mexico. In general, the spouse that requests spousal support must show proof for financial need of a specific dollar amount and the other spouse's eligibility to pay.

The court may consider the following factors when determining financial support:

  • The health and age of each party
  • The current income and potential income for each party
  • The length of the marriage
  • The standard of living in the marriage
  • The amount of property awarded in the division of community property

Types of Alimony in New Mexico

There are various types of financial support in New Mexico. A judge may award one type or a combination depending on the supported spouse’s situation.

  • Indefinite spousal support - Typically reserved for long-term marriages where one spouse is unable to become self-supporting due to age, disability, or other circumstances.
  • Rehabilitative support - This type of support provides the recipient with the education, training or work experience that increases their ability to earn an income.
  • Single, lump-sum support - These fall under two categories: 1) A specific amount paid in one or more installments that only ends when the recipient passes away and 2) A specific amount paid in one or more installments that is not subject to contingencies—meaning, even the recipient’s death won’t end the payments.
  • Temporary spousal support - A Judge may award this type of support during the divorce process if one spouse needs help paying for living expenses during the divorce or help paying expenses for the divorce itself.
  • Transitional support - Available to spouses who need to supplement their income for a limited amount of time, i.e, while they are waiting for their marital home to sell.

Our Albuquerque family lawyers can guide you towards an alimony agreement that works best for you and your family.

Is Alimony Paid For Life in New Mexico?

The duration of spousal support in a New Mexico divorce depends on the type of support awarded. Indefinite spousal support is paid until the supported spouse passes away or remarries.

How Long Do You Have To Be Married To Get Alimony in New Mexico?

You have to be married for five to ten years in New Mexico to receive alimony. The New Mexico spousal support law indicates that alimony is expected and provides that the family court shall reserve jurisdiction in marriages over twenty years.

The Importance of an Experienced Alimony Attorney

For the court to make a decision regarding alimony, both parties have to fully disclose all of their assets and liabilities. Those trying to reduce the amount they could have to pay in alimony will try to hide their assets. A competent Albuquerque family lawyer can effective investigate hidden assets or accounts, so you can get the full alimony you are entitled to.
